VILLAGE OF DEER PARK INVOLVED IN LAWSUIT

Lamar Advertising of Central Wisconsin, Marshfield, has filed suit against the village of Deer Park.

The post is located along the former right-of-way of the CNW Railroad near the highway 46 crossing.

According to the complaint, on March 27, 2003, Lamar's agent contacted the Deer Park village clerk about building a billboard on property located on Jim Krueger's property and was told to go ahead with construction of the sign.

But, according to the complaint, when work was started on June 16, the clerk contacted Lamar and asked that work stop and said that a building permit was needed.

In July the Deer Park Planning Commission denied Lamar's building permit, claiming the off-premise sign is not permitted in the commercial district. Lamar claims other off-premise signs have been allowed in the same district.

Another application was denied in December with the Planning Commission claiming this time that the sign would be in a floodplain. Lamar claims that nothing in the village's floodplain ordinance prohibits the construction of a sign.

Lamar claims discrimination and is asking the court to reverse the decisions of the Planning Commission and the Village Board and for reimbursement of costs and fees.
